Agreement to Terms

By accessing our website or engaging Raha Studio's real estate photography services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services. These terms apply to all visitors, users, and clients of our services.

Services Description

Raha Studio provides professional real estate photography services, including but not limited to:

HDR interior and exterior photography
Twilight photography sessions
Aerial drone photography and videography
Photo editing and post-production
Virtual staging (when applicable)
Delivery of high-resolution digital files

Service offerings, pricing, and availability are subject to change without notice. We reserve the right to refuse service to anyone for any reason at any time.

Booking and Payment Terms

Booking Process

Services are booked on a first-come, first-served basis. A booking is confirmed only when payment is received and a confirmation email is sent. We reserve the right to cancel bookings if payment is not received within the specified timeframe.

Payment

Payment is due in full before the scheduled photography session unless otherwise agreed in writing. We accept major credit cards, ACH transfers, and approved payment methods. By providing payment information, you authorize us to charge the agreed-upon fees.

Cancellation and Rescheduling

Cancellations made at least 48 hours before the scheduled session receive a full refund. Cancellations made within 48 hours are subject to a 50% cancellation fee. No-shows or cancellations made less than 24 hours before the session forfeit the full payment. Rescheduling requests made at least 24 hours in advance are accommodated subject to availability at no additional charge.

Intellectual Property Rights

Copyright Ownership

Raha Studio retains full copyright ownership of all photographs and creative work produced. Clients are granted a non-exclusive, non-transferable license to use the images for real estate marketing purposes related to the photographed property.

Usage Rights

Clients may use the photographs for:

MLS listings and online real estate platforms
Print marketing materials (flyers, brochures, postcards)
Social media marketing and digital advertising
Personal and professional websites
Property presentations and portfolios

Restrictions

Clients may not:

Resell, sublicense, or redistribute the images
Alter, manipulate, or edit the images without written permission
Remove watermarks or copyright information
Use images for purposes unrelated to real estate marketing
Transfer usage rights to third parties without authorization

Portfolio and Marketing Use

Raha Studio reserves the right to use images for our portfolio, marketing materials, website, social media, awards submissions, and promotional purposes unless the client requests otherwise in writing at the time of booking.

Client Responsibilities

Clients are responsible for:

Ensuring property access at the scheduled time and providing keys, gate codes, or access instructions
Preparing the property for photography (staging, cleaning, decluttering)
Obtaining necessary permissions from property owners for photography
Ensuring all lights, utilities, and amenities are operational
Removing pets or making arrangements for pet safety during the shoot
Communicating special requirements or concerns before the session
Verifying property address and access details are accurate

Additional fees may apply if the property is not ready or if access issues cause delays requiring rescheduling.

Delivery and Turnaround Time

Standard delivery is within 24-48 hours of the photography session. Premium and Elite packages may include same-day delivery options. Delivery times are estimates and not guarantees. Files are delivered via secure download link. It is the client's responsibility to download and store files; we are not responsible for failed downloads due to internet issues or expired links.

Weather and Force Majeure

We reserve the right to reschedule outdoor and aerial photography sessions due to inclement weather, unsafe flying conditions, or circumstances beyond our control. Clients will be offered alternative dates at no additional charge. No refunds are provided for weather-related rescheduling.

Revisions and Edits

All packages include professional editing and color correction. Minor revision requests (such as removing visible personal items or small objects) may be accommodated at no charge if requested within 7 days of delivery. Major editing requests, additional retouching, or extensive modifications may incur additional fees and are subject to our availability.

Limitation of Liability

To the fullest extent permitted by law, Raha Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

Use or inability to use our services or website
Lost sales, revenue, or business opportunities
Property damage during photography sessions
Technical failures, data loss, or file corruption
Third-party actions or omissions

Our total liability for any claim shall not exceed the amount paid by the client for the specific services in question. We maintain liability insurance for professional photography activities.

Warranty and Guarantees

While we strive for excellence, we do not guarantee specific outcomes or sales results from our photography. Services are provided "as is" without warranties of any kind, express or implied. We warrant that our work will be performed in a professional manner consistent with industry standards. If you are dissatisfied with the delivered photos, please contact us within 7 days to discuss resolution options.

Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. We collect, use, and protect personal information as described in that policy. By using our services, you consent to such processing and warrant that all data provided is accurate.

Dispute Resolution

Any disputes arising from these terms or our services shall first be addressed through good-faith negotiations. If resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. These terms are governed by the laws of the jurisdiction in which Raha Studio operates.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes become effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
